1. Acceptance of Terms

Welcome to Plantaera Biotech LLC. By accessing or using our website or purchasing products from us, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with these terms, please do not use our website or purchase products from us.

Plantaera Biotech LLC is a limited liability company based in Averill Park, New York, United States.

2. Products

Plantaera Biotech LLC sells living plant materials including, but not limited to:

  • In vitro tissue culture plantlets
  • Acclimated plants
  • Rooted cuttings
  • Seeds
  • Rare specimen plants

Because plants are living organisms, variation in size, appearance, coloration, and growth characteristics should be expected.

Product photos are representative and may not depict the exact plant received.

3. Limited Availability

Many products offered by Plantaera Biotech are produced in small batches.

We reserve the right to:

  • limit purchase quantities
  • cancel orders due to inventory errors
  • discontinue products at any time

Orders may occasionally be offered as limited releases or preorders. If preorder products are offered, estimated fulfillment times will be provided when possible but are not guaranteed.

4. Order Acceptance

All orders are subject to acceptance and availability.

We reserve the right to cancel or refuse any order for reasons including but not limited to:

  • inventory errors
  • suspected fraud
  • regulatory shipping restrictions
  • inability to safely ship plants to a destination

If an order is canceled, the customer will receive a full refund.

5. Shipping

Shipping policies, timelines, and delivery practices are governed by our Shipping Policy, which forms part of these Terms.

Risk of loss transfers to the customer when the shipment is accepted by the shipping carrier.

6. Returns and Refunds

Due to the perishable nature of live plants, returns are not accepted.

If a plant arrives damaged or in poor condition, customers must contact us within 24–48 hours of delivery and provide clear photos of the plant and packaging.

Refunds or replacements may be issued at our discretion in accordance with our Refund & Live Arrival Policy.

7. Assumption of Risk

Plants require appropriate care and environmental conditions.

By purchasing plants from Plantaera Biotech LLC, the customer acknowledges that:

  • plant survival depends on the customer's growing environment
  • outcomes cannot be guaranteed
  • specialized care may be required

Plantaera Biotech LLC cannot guarantee long-term survival, growth rate, or performance of any plant once it leaves our care.

8. In Vitro Plant Material

Some products sold by Plantaera Biotech are in vitro tissue culture plantlets.

These plantlets require specialized acclimation techniques when removed from culture vessels.

By purchasing in vitro plantlets, the customer acknowledges:

  • acclimation carries inherent risk
  • failure during acclimation is possible
  • successful transition depends on the customer's skill and environmental conditions

Plantaera Biotech LLC provides guidance but does not guarantee acclimation success.

9. Intellectual Property

All website content including text, images, graphics, logos, and branding is the property of Plantaera Biotech LLC unless otherwise stated.

This content may not be copied, reproduced, or distributed without written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Plantaera Biotech LLC shall not be liable for:

  • indirect damages
  • incidental damages
  • consequential damages
  • plant loss occurring after delivery

Our liability shall never exceed the purchase price of the product.

11. Indemnification

Customers agree to indemnify and hold harmless Plantaera Biotech LLC from claims, damages, or liabilities arising from misuse of products purchased through our website.

12. Governing Law

These Terms are governed by the laws of the State of New York.

Any disputes arising from these Terms shall be resolved within the jurisdiction of New York State.

13. Changes to These Terms

Plantaera Biotech LLC reserves the right to update or modify these Terms at any time.

Continued use of our website constitutes acceptance of the updated Terms.
